Internal rules

1 - PREAMBLE

These Internal Rules comply with the provisions of articles L.6352-3 and 5 and R.6352-1 to 15 of the Labor Code.
These Internal Rules are available for consultation by any trainee before starting the training. A copy of these rules is permanently posted on the training organization’s website at https://defense.evodriver.fr/

Purpose and scope of the rules
These rules apply to all persons participating in a training course organized by the Evodriver organization.
The rules define the health and safety rules, the general and permanent rules relating to discipline, as well as the nature and scale of sanctions that may be taken against trainees who contravene them, and the procedural safeguards applicable when a sanction is envisaged.
Everyone must comply with the terms of these rules for the entire duration of the training course.

2 - SECTION 1: HEALTH AND SAFETY RULES

Article 1 – General principles

The prevention of accident and illness risks is imperative and requires everyone to comply with:
– the regulations applicable to hygiene and safety on the training premises;
– any instruction imposed either by the Management of the training organization or by the manufacturer or the trainer, particularly regarding the use of the equipment provided.
Each trainee must ensure their personal safety and that of others by complying, depending on their training, with the general and specific instructions relating to hygiene and safety.
If he/she notices a malfunction in the safety system, he/she must immediately inform the Management of the training organization.
Failure to comply with these instructions exposes the person to disciplinary sanctions.

Article 2 – Fire instructions

In accordance with articles R. 4227-28 and following of the Labor Code, fire instructions and, in particular, a plan showing the location of fire extinguishers and emergency exits are posted in the EVODRIVER premises.
The trainee must take note of it.
In the event of an alert, the trainee must stop any training activity and calmly follow the instructions of the authorized representative of the training organization or the emergency services.
Any trainee witnessing the start of a fire must immediately call the emergency services by dialing 18 from a landline or 112 from a mobile phone and alert a representative of the training organization.

Article 3 – Alcoholic beverages and drugs

The introduction or consumption of drugs or alcoholic beverages on the premises is strictly prohibited. Trainees are forbidden to enter or remain under the influence of alcohol or drugs in the training organization or in the temporary premises used for training.

Article 4 – Smoking ban

In accordance with decree no. 2006-1386 of November 15, 2006, smoking is strictly prohibited in all enclosed and covered places that are open to the public or constitute places of work. This ban applies in particular to the rooms where the training takes place, as well as to all the premises where this ban is posted.

Article 5 – Accident

A trainee who is the victim of an accident—occurring during the training or during the travel time between the training location and their home or workplace—or who witnesses such an accident must immediately notify the Management of the training organization.
In accordance with article R. 6342-3 of the Labor Code, the head of the training organization takes the appropriate steps regarding care and makes the declaration to the competent social security fund.

3 - SECTION 2: GENERAL DISCIPLINE

Article 6 – Formalities associated with the training

Trainees are required to attend all sequences scheduled by the training provider with diligence and punctuality, without interruption. Attendance sheets are signed by the trainees, every half day, and countersigned by the instructor.
The trainee must fill in the attendance sheet as the course progresses and complete the satisfaction questionnaire at the end of the training.
At the end of the training course, the trainee is given a certificate of completion.

Article 7 – Training hours

Trainees must comply with the schedules set and communicated in advance by the training organization on the Convocation. Failure to comply with these schedules may result in sanctions.
Except in exceptional circumstances, trainees may not be absent during training hours.

Article 8 – Access to training premises

Unless expressly authorized by the Management of the training organization, the trainee may not:
– enter or remain on the training premises for purposes other than training;
– introduce, have introduced or facilitate the introduction of persons from outside the organization;
– engage in the sale of goods or services on the premises.

Article 9 – Dress code

Trainees are expected to present themselves to the organization in appropriate attire. Trainees must bring field-appropriate shoes and clothing suitable for weather conditions for outdoor modules.

Article 10 – Behavior

Trainees undertake to adopt behavior consistent with that expected in any community, as well as the rules set by the instructor.
They undertake to respect the duty of reserve and discretion allowing free expression of the group.
They impose the highest degree of politeness and courtesy among themselves and towards the staff they interact with.

Article 11 – Use of equipment

Unless specifically authorized by the Management of the training organization, training equipment is to be used on the training premises and is reserved exclusively for training activity.
The use of equipment for personal purposes is prohibited.
The trainee must keep the equipment entrusted to them for the training in good condition. They must use it in accordance with its purpose and according to the rules given by the instructor.
The trainee must immediately report any equipment malfunction to the instructor.

4 - SECTION 3: SANCTIONS AND PROCEDURE

Article 6 – Formalities associated with the training

According to the provisions of articles R. 6352-4 to R. 6352-8 of the Labor Code, some of which were modified by Decree 2019-1143 of 11/07/19.
A sanction is any measure, other than verbal observations, taken by the director of the training organization or their representative, following an action by the trainee considered by them to be faulty, whether or not this measure is likely to immediately affect the trainee's presence in the training or to call into question the continuity of the training they receive.
Fines or other financial penalties are prohibited.
No sanction may be imposed on the trainee without the trainee having been previously informed of the grievances against them.
When the director of the training organization or their representative plans to take a sanction that has an immediate or non-immediate impact on the presence of a trainee in a training course, the following procedure applies:
1. The director or their representative summons the trainee, indicating the purpose of this summons. It specifies the date, time and place of the interview. It is written and sent by registered letter or delivered to the person concerned against receipt.
2. During the interview, the trainee may be assisted by a person of their choice, notably another trainee.
3. The director or their representative indicates the reason for the intended sanction and collects the explanations of the trainee. The trainee’s employer is informed of this procedure, its purpose and the reason for the sanction envisaged.
The sanction is the subject of a written, reasoned decision, notified to the trainee by registered letter or delivered against receipt.
When the action has made an immediate temporary exclusion measure indispensable, no definitive sanction relating to this action may be taken without the procedure provided for in article R.6352-4 and, where appropriate, in articles R.6352-5 and R.6352-6, having been observed.
The director of the training organization informs the employer and the funding organization of the sanction taken:
– warning;
– written warning by the director of the training organization or their representative;
– reprimand;
– temporary exclusion from training;
– permanent exclusion from training.
